Malaysia Approved a New Order on Product Quantity Labelling

The Malaysia Government approved the Trade Descriptions (Marking of Quantity for Pre-Packaged Goods) Order 2023, which will revoke the Trade Descriptions (Marking of Pre-Packaged Goods) Order 2023. The Trade Descriptions (Marking of Pre-Packaged Goods) Order 2023 just began to be effective on 1 September 2023.

The new Trade Descriptions (Marking of Quantity for Pre-Packaged Goods) Order 2023 will enter into force on 4 June 2024.

The main change in this new Order is that the requirements for Product Name and Manufacturer’s Name and Address are no longer applicable.  Apart from these points, the content shown below is the same as the previous Order:

According to Order, the quantity of pre-packaged goods shall be declared according to the following measurements:

1. area in two dimensional figure of the goods
2. number of the goods in the package based on the actual count
3. length of the goods from end to end
4. weight of the goods from five grammes to fifty kilogrammes
5. volume of the goods from five millilitres to fifty litres

The goods shall be marked with the quantity of SI unit and the net count of the goods.

The information shall:

• Be legible
• Be in national language or national language and any other language where the goods originated from Malaysia
• Be in the national language or English where the goods originated outside Malaysia
• Be in colour that is clearly different with the background of the goods
• Have a minimum height of the fonts

The actual quantity of the pre-packaged good shall not be less than the nominal quantity. However, different number of non-conforming packaging for different lot size are allowed to have negative error grater than the tolerance deficiency shown in the following table:

The negative error should not be greater than twice of the tolerance deficiency.

For goods declared in length and area, the tolerable deficiency allowed shall 2% and 3% respectively of the nominal quantity for each packaging.

For goods declared in counts, the actual quantity shall not be less than the nominal quantity if the counts number is 50 or below. For the counts number more than 50, the actual quantity shall not be less than the nominal quantity on average and the negative error is one piece for each of the beginning hundred.
